    Division of assets upon divorce

    Horizontal property

  • Powers of attorney can be granted using one of these methods:

    Handwriting and Signature Recognition

    • The client drafts the document in the presence of a notary office employee.

    • Upon completion, the collaborator verifies his handwriting and signature (confirming that the text and initials are authentic).

    Authentication Statement

    • The client presents the already prepared power of attorney (handwritten or typed), and the notary's office employee prepares a statement to validate the document (the client confirms that they are aware of the content of the power of attorney and that it reflects their intention).

    • The client signs both the declaration and the power of attorney in the presence of the employee.

    Qualification of Heirs

    • The notary prepares the power of attorney according to the client's instructions.

    • The customer only needs to sign or apply their fingerprint to the document.

  • Required documents for executing a will:

    From the Tester

    • Citizen Card / Identity Card

    • Birth or marriage certificate (updated, with annotations if divorced/widowed)

    For Witnesses (2 required)

    • Original identification documents (Citizen Card or passport)

    • They cannot be heirs, spouses, or close relatives of the beneficiaries.

    Transfer of shares

    • Full identification (Citizen Card, Tax Identification Number, marital status, property regime) of the assignor, assignee, and spouses.

    • Permanent certificate of the company + updated articles of association

    • Updated statement of quota holders.

    • Consent of the company (written resolution, if required by the articles of association)

    • Declarations of no debt (Finance + Social Security)

    • Contract for the transfer of shares (value, payment, guarantees of absence of encumbrances)

    Unification of quotas

    • Full identification (Citizen Card, Tax Identification Number, marital status, property regime) of the partners involved.

    • Permanent certificate of the company + updated articles of association

    • Updated statement of quota holders (before and after unification)

    • Resolution of the partners approving the unification (written minutes)

    • Proof of receipt/payment of the unified fees.

    • Commercial registration form by transcription (to change company composition)

    Quota division

    • Full identification (Citizen Card, Tax Identification Number, marital status, property regime) of the partners involved.

    • Permanent certificate of the company + updated articles of association

    • Updated statement of shareholders (before and after division)

    • Resolution of the partners approving the division (written minutes)

    • Document for partial transfer or amortization of the resulting quotas (min. €1 each)

    • Business registration form for changing company composition.

    Capital changes

    • Full identification (Citizen Card, Tax Identification Number, marital status, property regime) of the partners.

    • Permanent certificate of the company + updated articles of association

    • Resolution of the partners (minutes of the general meeting approving the amendment)

    • Financial statement approved + list of partners

    • Statement from the administrative/supervisory bodies

    • Proof of entry/payment of the new capital (cash or assets)

    Liquidation of companies

    • Identification of partners/liquidators (Citizen Card, Tax Identification Number)

    • Minutes of the general meeting approving the dissolution and appointment of the liquidator.

    • Permanent certificate of the company + articles of association

    • Final settlement report and accounts approved.

    • Declarations of cessation of activity (Tax and Social Security)

    • Proof of debt settlement and division of assets

    Notarial Justification

    A notarial justification is a deed drawn up by a notary to compensate for the lack of formal documents in land or commercial registries, invoking prolonged possession (adverse possession) or declarations from interested parties.

    Certified photocopies

    • Original document to be certified.

    • Valid Citizen Card or Identity Card (or passport for foreigners).

    • The holder's presence is required for the conference.

    Signature Acknowledgments

    • Original document to be authenticated.

    • Valid Citizen Card, Identity Card or passport.

    • Proof of residence (if applicable).

    Delegation of Powers

    • Citizen Card/ID/passport of the grantor and attorney.

    • Permanent certificate of the company (if applicable).

    • Tax identification number (NIF) and address of both parties.

    • Minutes of the company's approval (for commercial management).

    Translation certificates

    • Original document in a foreign language.

    • Full translation into Portuguese (by a qualified translator).
